Recently Streeton Lawyers Senior Associate, Aaron Roberts, represented two separate clients who had each been charged with a single count of common assault (domestic violence related) offence in contravention of s. 61 of the Crimes Act 1900 (NSW).

In relation to the first client, the matter proceeded to sentence whereby Aaron was successfully able to persuade the Magistrate that no conviction should be recorded against our client, based on the low-level objective seriousness of the offence and the compelling subjective case of our client. The Magistrate agreed and a 12-month non-conviction bond was imposed.

In relation to the second client, the matter proceeded to a Hearing following a plea of not guilty. At the Hearing, the complainant was called to give evidence and was cross-examined. Our client also gave evidence and was cross-examined. Through thorough preparation with our client, including collating our documentary evidence which supported our client’s version of events, our client was ultimately found not guilty of the charge.
